Legislation before Congress that would require all fuel surcharges to be passed along to those who pay for diesel fuel would re-regulate the nation's trucking industry, says an executive at Total Quality Logistics, a rapidly growing freight broker in Union Township.

The legislation, co-sponsored by Sen. Sherrod Brown, D-Ohio, is backed by the 162,000-member Owner-Operator Independent Drivers Association, which complains the fuel surcharge isn't being passed on by brokers to independent truckers who face increasing diesel fuel costs.

Todd Spencer, executive director of the Kansas City-based independent drivers group, says too often freight middlemen push shippers to pay fuel surcharges, but pass along none or only part of the charge to the truckers who pay for the fuel.
